In Baltimore County, Maryland, the first-degree murder trial of John and Susan Griffin is in progress. Pathologist, Zabiullah Ali testified about the cause of Andrew Griffin’s death. It is difficult to believe that parents may be capable of inflicting such horrific abuse on a child that would ordinarily expect to receive love and sustenance from them. The autopsy of Andrew Griffin tells a tragic life story that was filled with pain and suffering.  Pathologist Zabiullah Ali described his observations through testimony in Baltimore County Circuit Court. He said that Andrew died from homicide with evidence of blunt trauma wounds too numerous to count. He also said that Andrew starved to death. Andrew was two months shy of his third birthday, yet weighed was a 4-6 month old infant would weigh.  

The defendants, John and Susan Griffin had six children between them by the time their trial began. Andrew died on December 26, 2007 at Towson Hospital. His autopsy was conducted the next day. Photographs at the trial told a gruesome story. There were multiple wounds in different stages of delayed healing as Andrew was too malnourished to heal. The pathologist testified that Andrew’s starvation was so advanced that his brain shrunk. There was evidence that he was even beat along the bottom of his feet. He had extensive head injuries as well. And because he was so debilitated he suffered from pneumonia and a blood infection with dehydration. The pathologist said Andrew’s emaciated appearance suggested that he probably could not walk.  

Interestingly, while the mother Susan Griffin was in jail pending the trial, the father John Griffin was allowed out on bail.

In Wisconsin, a three year-old girl was crying and then was smacked some more for continuing to cry, at least that is what Witt and Cantu allegedly told investigators. Stephanie Witt and Norbert Cruz Cantu, III have been arrested for child abuse. Witt’s three year-old daughter had to have emergency brain surgery for life-threatening injuries allegedly delivered by her own mother and her mother’s boyfriend.  

Witt was arrested and charged with reckless child abuse and intentional child abuse. Cantu is charged with intentional child abuse. Emergency medical personnel were called to the scene to find the three year-old unconscious with bruises located by her right ear and temple areas. 

The child was transported emergently to Mercy Hospital and then taken to University of Wisconsin Children’s Hospital in Madison for emergency surgery. The child likely received permanent brain damage.  

After the tragedy, Janesville Police arrested the duo. Unfortunately, they are both free on bond.

In Florida, Thomas James Ludwig is charged with first-degree murder in the December death of one of his twin daughters. News stories report that Mr. Ludwig arrived home around 8:00 pm on December 20, 2008. One of his twin daughters was crying. His roommates told investigators Mr. Ludwig handled the crying baby in a manner that caused the baby’s head to hyperextend backwards, then forcefully placed the baby on the bed, called her an expletive. The roommate then reported hearing a loud banging noise and then the baby stopped crying. Approximately 10 minutes later, one of the roommates went in to check on the babies and found the infant not breathing.  

The baby was transferred emergently to St. Joseph’s Hospital in Tampa where she died the next day. An autopsy revealed the baby died of significant blunt trauma to the head with skull fractures and hemorrhage.

In Iowa, the trial of Amy Sunclades has been moved to June.  She will stand trial for allegedly causing Shaken Baby Syndrome and is charged with child neglect or abandonment and child endangerment causing serious injury. She is accused of shaking a 3-month-old infant on May 7 in her home-based daycare.

In California, Joe Hudson plans to sue Fresno County Department of Children and Family Services for the death of his son, Seth Ireland. Lebaron Vaughn and Rena Ireland remain in police custody. Between August and December 2008, multiple complaints from different callers to Fresno County CPS regarding the child abuse of Seth Ireland and his sibling were received from the department of children’s services, yet the children were not removed from the home of Ireland and Vaughn. Someone in the department determined that Seth was not in eminent danger. Now Seth is dead, he became another tragic victim of child abuse at the hands of a mother and mother’s abusive boyfriend.

In Utah, Cameron Clint O’Bannon, 30 years-old, was sentenced for the serious shaken baby brain and eye injuries he inflicted on his girlfriend’s son. Last year he was convicted of second-degree felony child abuse involving his girlfriend's son who was left partially blind from his injuries.  A judge also ordered Mr. O’Bannon to serve probation, pay fines and restitution and medical/counseling costs for the victim. He was also ordered to complete a domestic violence program and write a letter apologizing to the victim.

In Michigan, Mannie Lee Holmes, III will face one count of felony murder for first degree child abuse in the death of infant, Christian Holmes. Four month-old Christian Holmes died on October 4, 2008. Mr. Holmes brought Christian to Bronson Hospital on September 12th with the complaint that the infant was unresponsiveness. Healthcare providers discovered that Christian had a severe brain injury.

In Utah, Mary Heath and Sekoa Aiono have been sentenced for their roles in the child abuse of Heath’s niece and nephew. New stories previously reported the extent to which Heath’s niece and nephew had been subjected to a lack of clothing, inadequate food provision, being locked in separate rooms and regular beatings. The children both managed to survive these tragic conditions until one escaped from the home and told neighbors and police what was happening inside the home. The nephew suffered life-threatening conditions until his rescue.

In Illinois, Yulissa Chavez, a 6-month-old baby girl, died from suspected child abuse at Cook County Hospital. News stories report that one man is in custody. An autopsy is expected to be conducted today. Very little details are known at this point. Aurora Police Department and DuPage County Child Advocacy Center are conducting an investigation into the matter.

In Colorado, jury selection in process for the trial of Alex Midyette facing charges for the death of his son, Jason Midyette. Alex Midyette is the 29 year-old father to deceased baby, Jason Midyette. Jason died from injuries sustained during alleged child abuse. The investigation reveals that Jason had a skull fracture and over 20 fractures elsewhere in his body. He died in 2006. This trial has been moved and post-poned twice. Molly Midyette, the deceased infant’s mother, has already been tried and convicted. She is serving 16 years in prison.

In Nebraska, Tatiana Riveria died from her injuries. Her father, Augustine Rubio faces charges related to her death. Tatiana was severely injured while in the care of her father. The investigation revealed she had three skull fractures. Her injuries were so severe, life support measures were thought to be futile and doctors removed her from life support. Douglas County prosecutors say the charges against Mr. Rubio will be changed from felony child abuse to child abuse resulting in death.

In Colorado, Alex Midyette, 29 year-old, allegedly kicked his wife in the stomach while she was pregnant. Perhaps this was an indication of things to come as he faces child abuse charges for the 2006 death of his infant son, Jason.  The investigation reveals that Mr. Midyette used cocaine and was viewing pornography just hours before he brought his infant son to a local hospital with fatal injuries.

In Colorado, Molly Midyette was sentenced to 16 years in prison because of a failure to seek medical help for fatal child abuse injuries suffered by her son, Jason, in 2006. The baby’s father, Alex Midyette, faces trial for child abuse charges this week.  

Prosecutors state that Alex Midyette kicked his wife in the stomach while she was pregnant with his son. Prosecutors also intend to bring evidence to trial that indicates Alex Midyette had used cocaine and was viewing pornography hours before the baby was brought to the hospital with fatal injuries including a skull fracture and broken bones.

In Nebraska, Augustine Rubio is charged with the death of his infant daughter, Tatiana Riveria. Tatiana was pronounced dead on January 9th at Creighton University Medical Center. Meanwhile Mr. Rubio is being held in the Douglas County Corrections Center.  

Emergency response personnel responded to a call to the home of Rubio on Wednesday evening for a call regarding a child not breathing. Tatiana was emergently transferred to Bergan Mercy Medical Center and later transferred to Creighton for critical care.  

In addition to criminal proceedings, victims and their families have the right to pursuit civil litigation for their losses as well.

In Chicago, tragically Alex Angula was killed by his foster family’s dogs this past Sunday. He was four years-old when he died. This tragic death was completely preventable. In West Virginia, Elizabeth Dawn Thornton and Christopher Washburn will face separate child abuse trials for the death of their baby boy, Constantine Alexander Washburn. Jury selection and opening statements have already taken place. The baby boy, Alex, died on May 31, 2008 at CAMC Women and Children’s Hospital in Charleston from severe brain injuries. The parents failed to seek medical attention and news stories report that a friend called an ambulance three days after the injuries occurred.  Ms. Thornton was charged in June and Mr. Washburn was charged in September 2008.

In Fresno, Rena Ireland and LeBarron Vaughn are charged with the murder of Seth Ireland (Hudson), a 10-year-old boy. Allegedly, Rena was the boy’s mother and allegedly, Vaughn was the abusive and controlling boyfriend of the mother who recently moved in with her. According to witnesses, Child Protective Services had plenty of warnings and indications that child abuse was occurring in this home.  Joseph Hudson tried to get the attention of CPS, the school principal wrote them a letter and then there were police reports. What about the prior encounters with CPS? And don’t forget the violence in the home that the neighbors reported, what happened to those reports? What does it take for police and CPS to take these reports seriously? Ireland’s family told the press they tried to get involved but Vaughn kept them away.  

Joseph Hudson’s son, Seth, told him he was frightened to go back home to his mom and Vaughn. Fourteen days later, Seth was hospitalized and fighting for his life due to child abuse and blunt force trauma.  News reports state that on December 29th, Vaughn kicked, punched and stomped on Seth’s head. Can justice come swiftly enough for Vaughn?  

Catherine Huera, Child Protective Services, is quoted as saying, “Really, the bottom line when you’re investigating a case, it’s not only what you know, but it’s trying to figure out what you don’t know. And sometimes what you don’t know is where the secrets are.” Brilliant quote Ms. Huera – “secrets” are what you don’t know or what is concealed from others. Only in this case the child abuse was evident, everyone saw it. Who was managing this CPS case? Was CPS waiting for Vaughn to deliver a body to their doorstep?

In West Virginia, Theresa and Oscar Hyatt are charged with child neglect for the death of Danny Cole. Danny was three years-old when he died while under the care of the Hyatt couple. The investigation reveals that the Hyatts were babysitting when Danny received a lethal dose of Methadone. In news stories, Theresa Hyatt states “I assume what I gave Cole was Benadryl, why would Methadone be in my car?” That’s a good question; among many questions that Ms. Hyatt will have an opportunity to answer in the future.

In Oregon, Maxine Polanco has been charged with murder for the death of her two year-old son. Umatilla County District Attorney Dean Gushwa alleges Polanco murdered her son by chronic child abuse. On Friday, the child was taken emergently to Doernbecher Children’s Hospital in Portland where the boy died from head and liver trauma.  

According the news stories, the deceased child’s mother, Ms. Polanco, has a past history of drug crimes.

In Denver, preliminary hearings were held Monday for Isela Reyes-Talamantes and John Vigil. Both are defendants in the case involving the death of Elijah Archuleta. Elijah was two years-old when he died from scalding burn injuries. Prosecutors argue that the defendants waited nine hours before seeking medical attention for their son.

In Illinois, Pernell Hampton, 34 year-old, pled guilty to two counts of unlawful delivery of a controlled substance. Deanna Johnson, a four year-old girl is dead. Her death took place in November of 2007. Charges against the mother of the deceased child are pending. New stories have not released the mother’s name. Deanna was allegedly injected with morphine and died. She was dead upon arrival of the EMS. Deanna’s siblings have since then been removed from the home and are in protective custody.

In North Carolina, Tyler McMillan was only 13 years-old when he died last June. News stories report that he was tied to a tree as punishment on more than one occasion. This last occasion brought a sad ending to his life. The investigation revealed he was covered with bug bites, bruises and missing flesh from trauma. Wounds on his wrists and ankles have the appearance of previous use of plastic ties around his distal extremities. When he arrived to the hospital his body temperature was 105.6 degrees and he was severely dehydrated. His siblings have been placed in protective custody by the Department of Social Services.  

A Hearing in Edgecombe County court is scheduled for January 13, 2009. Sandra and Brice McMillan face murder and felony child abuse charges. Sandra McMillan is the stepmother to Tyler.

In California, David Blanks is a suspect in the Shaken Baby case of his infant daughter. In December, Blanks and the infant’s mother, Corinna Heath brought the infant to Barstow Community Hospital for emergency treatment of seizures. Healthcare providers found retinal hemorrhages and bleeding in the brain. The infant required critical care and was sent to Loma Linda Medical Center. The baby also had rib fractures.  

Mr. Blanks was arrested and remains in the San Bernardino County Jail.
