In California, Southern CA mom convicted in son's beating death | California Child Abuse Attorney

A Southern California woman who reportedly called 911 two days after her 2-year-old son was severely beaten by his stepfather has been reportedly convicted of second-degree murder and child abuse.

The Riverside Press-Enterprise reports (http://bit.ly/PR1tT3) Davia James of Banning faces a potential life sentence after being convicted Wednesday.

Andrew Lee Payne has reportedly been convicted of similar counts in the death of Robert Vorhees.

Authorities said Payne reportedly watched the toddler while James was away. When she came home, he told her the boy accidentally fell and was sleeping under the cover.

The child reportedly lay in bed for two days, and James didn't call 911 until she heard him struggling to breathe.

During trial, the defense reportedly said James didn't realize the extent of the injuries and wasn't surprised her son slept day and night.
