In Virginia, Ann Marie Cardinal was freed from jail after a new sentencing hearing. She was serving time for charges in connection with the 2005 death of Hannah Weiss. Ms. Cardinal allegedly has prior convictions. News stories report that she allegedly was the subject of prior complaints to Child Protective Services and was convicted in 2000 of a misdemeanor. In 2001, Ms. Cardinal was convicted of conspiracy to obtain money under false pretenses. Allegedly, as a convicted felon she was prohibited from providing day care but continued to advertise as a legitimate day care until the death of Hannah Weiss happened in her home. Allegedly, the Hannah’s mother thought Ms. Cardinal was licensed to run a day care after seeing a framed certificate hanging on Ms. Cardinal’s wall. Hannah’s death was ruled sudden unexpected infant death with no anatomic cause. News stories reported that Circuit Judge H. Thomas Padrick, Jr. complained that the General Assembly had not crafted a statute that sufficiently addresses the deceptive behavior demonstrated by Ms. Cardinal. In this news article that judge is quoted as saying, “It’s a huge tragedy all around, and at the same time, it’s an alarm bell for parents seeking day care for their children. The state’s not going to help them much.”
